Second YIMC Results 7/11/2016

The National Law School of India University, Bangalore, narrowly edged out Strathmore University in the Second Young International Mediation Competition held in July 2016 in Hong Kong.  The teams, representing Quality Manufacturing Ltd and its longtime customer Carlson Heating & Air Conditioning Co, had run into difficulties following a delay in installation due to problems with the new air-conditioning units to Carlson.
After a week of negotiations, the two top-ranking teams met on 9 July 2016 at Herbert Smith Freehills offices with mediator Danny McFadden to attempt to reach a mediated compromise that would respond to both parties' interests in a final round, which capped a week of mediation training and facilitated negotiations.
The YIMC is unique in its structure in that it begins with mediation training and it includes competitions for both counsel teams and student mediators. "We've seen a substantial upswing in the use of mediation, but still many lawyers regard it with suspicion," said VEMF director Louise Barrington. "Some lawyers think mediation is only for family and community disputes.  Once they realise how useful mediation can be in finding creative solutions for business disputes, it becomes a realistic alternative to arbitration or court. With the competition, law students learn early in their careers to master the skills they need to succeed in the mediation process."
Student were very enthusiastic about the competition and it is growing in popularity each year. This year, the competition saw the winner of the Best Mediator’s Award in the Inaugural competition coming back with a team from Edith Cowen University.
